民主正当性视野下的检察官统一调用制度

在民主正当化链条理论的视野中,检察官统一调用制度具有鲜明的功能取向,其与"检察一体"原则的关联指向保证检察权的统一有效行使,因此可获得宪法功能与制度层面的正当性.在保证个案关联度的前提下,检察官统一调用并不构成实质上的任命,被调用检察人员的人事正当化链条保持存续,同时,地方人大及其常委会的地方性不能否定检察权及其分配的统一性和法定性,检察官由此可以跨院履职.但是,检察官统一调用对调出地与调入地检察机关的工作均可能产生影响,并由此影响两地检察机关与人大常委会的责任链条,因而调用一般需要获得两地检察机关及同级人大常委会的同意,避免民主问责的落空.通过遵循一定的调用条件,检察官统一调用将不会影响原有民主正当化水平.
Abstract
In the context of the theory of the chain of democratic legitimization,the system of unified transfer of prosecutors has a distinct functional orientation,and its inkage with the principle of"procuratorial integration"is directed towards guaranteeing the unified and effective exercise of prosecutorial power,and thus obtains functional and institutional legitimacy.On the premise of ensuring the relevance of individual cases,the unified transfer of prosecutors does not constitute a substantive appointment,and the chain of legitimacy of the personnel of the transferred prosecutors is maintained;in the meanwhile,the local nature of the local people's congresses and their standing committees cannot negate the unity and legality of prosecutorial power and its distribution,and prosecutors can thus perform their duties across institutions.However,the unified transfer of prosecutors may have an impact on the work of both the transferring and incoming prosecutors and the NPC Standing Committees,and thus affect the transfer generally requires the consent ofn the prosecutors of the two places and the NPC Standing Committees at the same level,in order to avoid the failure of democratic accountability.By adhering to certain conditions of transfer,the unified transfer of prosecutors will not affect the original level of democratic legitimacy.
