摘要
新《行政复议法》中的变更决定制度包括三个功能导向,分别是发挥化解行政争议的主渠道作用、实质性解决行政争议、强化基于行政自制的内部监督.变更决定在否定原行政行为效力上与撤销决定存在质的区别;变更决定与部分撤销决定分别适用于原行政行为不同的处理结果;变更决定与责令重作决定择一适用需考虑两个因素.变更决定的三种适用情形呈现出行政行为违法程度依次递进的格局,应从决定结果、法律适用、事实认定三个方面推动变更决定的适用空间扩容.禁止不利变更原则在变更决定制度中具有"安全阀"的作用,应避免变更决定的优先适用地位受到不当抑制,允许补充适用驳回复议申请决定.变更决定中心主义已经初现端倪,但其实效性仍然有待检验.
Abstract
The function of the alteration decision system in the new Administrative Reconsideration Law includes three dimensions:function as the main channel role in resolving administrative disputes,substantially resolving administrative disputes,and strengthening internal supervision based on administrative self-discipline.There is a qualitative difference between an alteration decision and a revocation decision in negating the effective-ness of the original administrative act.The alteration decision and the partial revocation decision are applicable to the different processing results of the original administrative act respectively.Two factors can be considered in the choice between an alteration decision and a decision of ordering to redo activities.The three applicable situations of alteration decisions present a progressive relationship between the degree of illegality of administrative activities.Through the three dimensions of decision making,law application and fact examination,the expansion of the application of the alteration decision should be promoted.The principle of prohibition of adverse alteration function as the safety valve in alteration decisions,which should avoid unproperly extracting the preferential application of alteration decisions and allow the supplementary application of rejecting the reconsideration appli-cation.The centralism of alteration decisions has begun to emerge,but its effectiveness remains to be tested.
