The Relationship between Villagers'Self-Governing Organizations and Rural Collective Economic Organizations:Reflection on Developing New Rural Collective Economy
The intertwined relationship between villagers'self-governing organizations and rural collective economic organizations result in the cognitive confusion about the subject of the exercise of collective ownership in theory and practice.The farmers'collective body is the subject with villager autonomy and collective ownership,and both villagers'self-governing organizations and rural collective economic organizations are the executive bodies of the farmers with different functions.Based on the structure of property rights in which the subjects of collective ownership are divided,the legislation establishes the rural collective economic organization as the ex officio subject of collective ownership through the right exercise mechanism of the representative subject,thus alleviating the problem of the virtualization of the subjects of collective ownership.In areas where rural collective economic organizations have not been established,villagers'committees and villagers'groups exercise collective ownership on behalf of the farmers in accordance with the law,discussing and deciding on the operation,man-agement,and distribution of proceeds of the collective property with reference to the resolution rules of the rural collective economic organizations.Under the representative relationship with the classification of village-level and group-level,villagers'groups may hand over their representative functions to villagers'committees,but may not change the established relationship of collective ownership.
