On Controlling the Recidivism of Property Crimes through Deterrence Theory
The deterrence theory is introduced to analyze the current management situation of property crime for its high rate of incidence and recidivism.It also analyzes the factors of deterrence failure from the personality and environment,as well as psychological mechanisms of recidivists in their decision-making.It sums up three major reasons for the failure of legal deterrence and recidivism of the potential criminals,that is,the ignorance of the law,the less penalty than other factors,and the uncertainty of the punishment.Therefore,measures should be taken in three perspectives of cognition,emotion and volition by means of cultural,vocational skills and legal education to re-socialize ex-convicts and encourage the active monitoring investigation balancing the combat and prevention.It emphasizes the positive effects of deterrence and decreases the negativeness,and provides a new study perspective and solution plan to reduce the recurrence rate of property crimes.
