Research on Ethics and Legal Regulation of Informed Consent Rights in Application of Brain-Computer Interface Technology
As the research on brain-computer interface(BCI)technology continues to deepen,the scientific and technological ethical and legal regulation issues related to the application of BCI technology need to be resolved.Taking the issue of informed consent rights in medical and entertainment applications of BCI technology as an entry point,this paper analyzes the differences in the needs of different user groups in the process of informed consent,and discusses the difficulty of users'understanding of BCI technology and its impact on effective informed consent.The applicability of the Civil Code of the People's Republic of China and other legal norms to the application of BCI technology from the perspective of legal regulation.Based on the protection of informed consent rights in BCI application scenarios,suggestions such as hierarchical informed consent process and establishment of dynamic supervision mechanism are put forward.
