The Construction of China's Personal Credit Information Collection Rules
The digital society not only builds a solid material foundation for the construction of the credit society,but also puts forward higher requirements for the improvement of the credit system.China's Personal Information Protection Law has established the informed consent plus exception rule for personal information collection.The current Credit Industry Management Regulations have not established special rules for credit information collection that adapt to the development of the credit industry,unable to adapt to the comprehensiveness and complexity of credit information in the digital era,and limiting the scope of use and reducing the effectiveness of credit reports.In order to achieve a balance between personal information rights and social public interests,it is recommended to establish differentiated rules for personal credit information collection and utilization,namely,the collection notification rule and utilization consent rule.Credit institutions can collect personal credit information to the maximum extent to ensure comprehensiveness,integrity and authenticity of credit information.At the same time,in order to prevent improper infringement of personal rights,it is possible to increase the conditions for the establishment of credit institutions and adopt the administrative license system,requiring credit institutions to bear the obligation of cautious attention in information collection,not to collect information beyond the scope,and to conduct preliminary review of the authenticity of information.At the same time,data sharing should be strengthened,and the industry access and exit mechanism should be improved.
