摘要
近年来,我国不断加大反垄断力度,而城镇燃气是公用事业的代表性行业,成为反垄断重点关注对象,该领域反垄断工作变得愈发重要.为了进一步做好城镇燃气领域反垄断工作、推动城镇燃气行业高质量发展,对我国城镇燃气领域反垄断监管进行了系统回顾,总结了其垄断行为的不同类型,梳理了城镇燃气领域现有反垄断监管相关法律法规,分析了城镇燃气领域反垄断执法典型案例及目前存在的一些突出问题.在城镇燃气领域反垄断现有工作的基础上,分别向政府监管部门、燃气行业协会、城镇燃气企业提出了工作建议:①政府部门可适时推动城镇燃气领域市场化改革,持续完善行业反垄断相关配套机制,反垄断监管机构和行业监管部门应全面落实科学监管,注重管罚平衡;②以燃气协会为代表的燃气社会团体可倡导建立城镇燃气领域垄断行为防范制度,做好反垄断宣传和交流;③城镇燃气企业可加强内部反垄断自查,不断完善反垄断合规制度体系,妥善处理用户投诉和反垄断调查.
Abstract
The state has been continuously strengthening anti-monopoly law enforcement in recent years.Urban gas,as a representative field among public utilities,is the major concern in anti-monopoly.Thus,the anti-monopoly in this field is increasingly crucial.In order to further implement this anti-monopoly to promote quality industrial evolution,the national anti-monopoly supervision in this field was reviewed and different types of monopoly behaviors were summed up.Then,current laws and regulations related to this supervision were sorted out,and many classic anti-monopoly law enforcement cases were analyzed.Several remarkable problems were put forward.In addition,dependent on anti-monopoly supervision in the field of urban gas,three suggestions have been made to the government's regulatory authorities,gas industry associa-tions,and urban-gas enterprises.First,the government shall appropriately seek market-oriented reforms in the urban-gas field,and constantly improve related supporting mechanisms on industrial anti-monopoly.And anti-monopoly supervising organizations and industrial supervising authorities shall implement scientific supervision fully and emphasize on supervi-sion-punishment balance.Second,gas mass organizations represented by gas associations shall advocate system construc-tion to avoid monopoly behaviors and perform anti-monopoly publicity and communication actively.At last,the inside check against anti-monopoly shall be strengthened by the urban-gas enterprises to perfect the anti-monopoly compliance system and give properly response to users'complaints and anti-monopoly investigation.
