摘要
真人图书是著作权法意义上的作品,受著作权法保护.文章分析指出图书馆在真人图书合理使用过程中面临的现行著作权合理使用相关法律规定不完善、图书馆固化真人图书存在较大著作权侵权风险、相关人员著作权合理使用法律意识淡薄等困境,并提出真人图书著作权合理使用的策略,即颁布专门针对图书馆著作权合理使用的司法解释,制定图书馆真人图书著作权合理使用的具体措施,以及强化相关人员真人图书著作权合理使用的法律意识.
Abstract
Living books are works in the sense of copyright law and are protected by copyright law.The article points out the difficulties that libraries faced in the process of fair use of living books:the current legal provisions related to fair use of copyright are not perfect,there is a significant risk of copyright infringement in the solidification of living books by libraries,and the legal awareness of fair use of copyright among relevant personnel is weak.It also proposes countermeasures for the fair use of copyrights in living libraries,namely the issuance of specialized judicial interpretations for the fair use of library copyrights,develop specific measures for the fair use of living book copyrights in libraries,and strengthen the legal awareness of relevant personnel on the fair use of living book copyrights.
