Legal Attributes and Infringement Regulation of NFT Digital Collectibles
The article explains the technical logic of NFT digital collectibles,points out that NFT digital collectibles have attributes of non data,non material,non network virtual property,and information network dissemination,analyses infringement behavior types of NFT digital collectibles:failure to obtain legal authorization before going on the chain and damage to the only carrier of the work after going on the chain.From the perspectives of private law regulation in copyright law and contract law,as well as public law regulation in administrative law and criminal law,targeted regulatory paths for NFT digital collectibles infringement are proposed,including reasonably determining the infringement liability of third-party platforms,clarifying convention whether the carrier of the work has uniqueness,reasonably grasping the limits of administrative penalties,playing the role of copyright infringement.
