Construction of Copyright Rules for Digitization of Out-of-print Books in China
The article elaborates on the practical value of digitizing out-of-print books,analyzes the obstacles faced by the digitiza-tion of out-of-print books,such as limited role in the reasonable use system,difficulty in applying the statutory licensing system,and urgent need to improve the collective management system.By summarizing the experience of the extended collective management system in Northern Europe and the presumed collective management system in France,the article proposes strategies for constructing copyright rules for out-of-print books in China,including carrying out the compilation and review of out-of-print book catalogs,strengthening the construction of portal websites and databases,establishing mechanisms for the free exit and encouragement of rights holders,and setting up mechanisms for dialogue and consultation among relevant parties.
