摘要
严格规范公正文明是对执法主体、执法程序、执法行为、执法效果的整体性要求.构成要件论、程序正当性、目的兼手段、外观兼方式是执法行为是否符合严格规范公正文明的四项标准.在严格规范公正文明执法的指导下,综合执法体制改革应实现职权法定、多元程序约束、裁量权定限、方式优化,从而不断推进执法理论实践化发展.
Abstract
Strictness,standardization,fairness and civilization are the overall requirements of the main body of law enforcement,law enforcement procedures,law enforcement behaviors,and law enforcement effects,and are organically connected with each other.The four criteria of"compositional elements theory","procedural legitimacy","purpose and means"and"appearance and method"can be used to test whether the specific law enforcement behavior conforms to strict norms and fairness and civilization.Under the guidance of strict,standardized,fair and civilized law enforcement,the reform of the comprehensive law enforcement system should realize the legality of functions and powers,pluralistic procedural constraints,limitation of discretion and mode optimization,so as to continuously promote the development of law enforcement theory and practice.
