超大城市治理中的人居环境法构造

摘要
随着我国现代化进程的推进,超大城市中的人居环境问题日益凸显,该问题如何进行制度化应对是超大城市治理的重要面向.人居环境问题的治理应遵循环境法的制度路径,但人居环境又具有人工化、与居民密切关联等特征,其保护制度需要适应其特征进行发展和创新.人居环境法是环境法一个相对独立的分支,其目标和制度要在环境法体系中确定,并协调与相关制度的关系.其中,政府的行政管理制度和民事制度仍是人居环境法律制度的基本方面,具体内容要根据人居环境保护的特征和具体需要来设计.
Abstract
The human settlement environment problem in megacities is increasingly prominent,and its institutional response is an important aspect of megacity governance.Human settlement environment problem is a type of environment problem,and its response should follow the institutional path created by environmental law.However,human settlement environment has the characteristics of artificialization and close association with residents,and its protection system needs to adapt to its characteristics for development and innovation.Human settlement environment law constitutes a relatively independent branch of environment,and its objectives and systems should be determined within the environmental law system,and the relationship with related systems should be coordinated.The government's administrative management system and civil law system are still the basic aspects of the legal system for human settlement environment,and their specific contents should be designed according to the characteristics and specific needs of human settlement environment protection.
