在市场激励下,数据商业化利用的深度和范围进一步加大,这一方面有效激发了市场活力,使技术创新和商业模式不断迭代更新,但另一方面也导致了市场的不确定性和风险扩散.因此,创新发展与风险控制成为数字时代市场监管的重大命题.反垄断法作为市场经济的基本法,需要回应如何"以技术对技术",实现智慧监管,提升监管的精准性、及时性和有效性.在技术革命、新经济蓬勃发展的时代图景下,数字化赋能和生成式人工智能为智慧监管提供了技术支撑,但也伴生着新的问题.对此,要以务实、开放的思维认识反垄断智慧监管的新使命和理念变更,客观、理性看待智慧监管的局限性,以积极严谨的态度构建具有可行性和实用性的制度,推动科技与法治的有机融合,真正实现反垄断的智慧监管.
Abstract
Under market incentives,the commercial utilization of data profoundly impact economic and social development.On one hand,this effectively stimulates market vitality,fostering continuous technological innovation and diverse business models.On the other hand,it also leads to the diffusion of market uncertainties and risks.Consequently,the innovation-driven development and risk control become significant propositions for market regulation in the digital era.Digital empowerment and generative artificial intelligence provide both technical support and new challenges for intelligent regulation.It is imperative to approach the new mission and paradigm shift of anti-monopoly intelligent regulation with an open mindset,objectively and rationally evaluate the limitations of intelligent regulation,aiming to achieve the organic integration of technology and rule of law,and truly realize the"intelligent"regulation of anti-monopoly.
