A Critique on the Rules Concerning the"Restricted and Prohibited Waters"Enacted by Taiwan Authority:Analyzing the 2/14 Fatal Boat Incident from the Perspective of International Law
After the 2/14 Fatal Boat Incident,both sides of the Taiwan Strait have been contending against each other,which reveals the confrontation between them.Originating from the"Act Governing Relations between the People of the Taiwan Area and the Mainland Area",the"restricted and prohibited waters"was set up under the fundamental premise that the"Taiwan Area"and the"Mainland Area"belonged to China,not implicating the partition of sovereignty of China.Such fact can never be denied by anybody.For the purpose of coastal defense,the"restricted and prohibited waters"was temporarily established as the buffer zone by Taiwan Authority based on its belligerent status.Its legal effect shall be limited within the"Taiwan Area"which is under the effective control of the Taiwan Authority.And it does not impose the Central Government the obligation to prevent mainland vessels from entering into the"restricted and prohibited waters".Nevertheless,in order to protect the security of lives and property of mainland fishermen and safeguard maritime order,the Central Government has always implemented the policy of dissuading mainland vessels from entering into the"restricted and prohibited waters".It is a pity that the Central Government's respect to Taiwan Authority fails to win the equal respect in return.In the 2/14 Fatal Boat Incident,the Taiwan Authority not only treated mainland fishermen rudely and infringed the safety of their lives,but also shirked its responsibilities.Consequently,Taiwan Affairs Office of the State Council openly denied the existence of the so-called"restricted and prohibited waters"so as to declare China's sovereignty over it.
