摘要
针对人工智能安全发展要求,基于人工智能发展现状,分析了当前生成式人工智能生成内容治理所面临的困境并提出了治理建议.在坚持生成内容可被版权保护的前提下根据实质贡献与利益平衡原则确定版权归属;坚持安全与发展并重的理念,在立法与监管两方面提出具体措施以探寻符合我国国情的风险治理之道;在具体责任承担上,引入安全港机制划分服务提供者和使用者各自的责任.
Abstract
According to the safety development of artificial intelligence(AI)and the current situation of AI development,this pa-per analyzes the difficulties faced by the management of generated AI content,and puts forward some management suggestions.On the premise that the generated content can be protected by copyright,the copyright ownership should be determined according to the princi-ple of substantial contribution and balance of interests;In the aspect of legislation and supervision,it puts forward concrete measures to explore the way of risk management which is in line with our national conditions,and in the aspect of concrete responsibility undertak-ing,it introduces the safe harbor mechanism to divide the responsibility of service providers and users respectively.
