The Second-order Structure and Normative Approach of"Illegality"of Personal Information Infringement
"Illegality"has the function of balancing the protection of personal information rights with commercial use.Personal information infringement is not premised on violation of regulatory norms,for a breach of regulatory norms does not necessarily lead to personal information infringement.The act that breaches legal provisions aiming at safeguarding personal information constitutes an infringement of per-sonal information rights.In cases of personal information infringement,the essence of the infringement law of"protecting others"necessitates a distinction between the regulatory norms and protective norms within the Personal Information Protection Law.As handling personal information infringement is often in-terfered by"concealment of fault elements",based on the protective norms centering on fault,the second-order structure of"illegality"in infringement behaviors of personal information infringement must be clarified,and a differentiated approach to"illegality"of such infringements should be adopted.When there is an act of concealing fault elements,the"presumption of illegality"method is proposed,where the illegal act can be overturned,thus achieving the comprehensive protection against personal informa-tion infringement.
