数字体育背景下全民健身数据隐私的法律保护研究

数字体育背景下,全民健身走向时代新高度,数据赋能全民健身现代化发展,全民健身不断迸发出新动能,不断满足人民群众日益增长的健康需求.与此同时,全民健身数据隐私引发广泛担忧.在推动全民健身数字化升级的同时,全民健身量化隐私风险、海量数据失控风险、健身数据难于追溯等问题突出,法律保护机制也尚未完善.基于现有问题及法律制度的分析,得出全民健身数据隐私法律保护制度的建构应从构建"法律+技术"二元保护规则体系、架构多元主体协同模式、完善主体义务履行机制、优化数据隐私知情同意原则、健全平台数据隐私的内部保护制度这五方面入手,以此构筑全民健身数据隐私保护新优势.
Research on the Legal Protection of National Fitness Data Privacy in the Context of Digital Sports
Digital sports era of national fitness towards the era of new heights,data-enabled modernization and development of na-tional fitness,national fitness continues to burst new momentum,and continue to meet the people's growing demand for high-quality sports and health.At the same time,the privacy of national fitness data has caused widespread concern.While promoting the digital-ization and upgrading of national fitness,problems such as the risk of quantitative privacy of national fitness,the risk of losing con-trol of massive data,and the difficulty of tracing fitness data are prominent,and the legal protection mechanism has not yet been per-fected.Based on the analysis of the existing problems and legal system,it is concluded that the construction of the legal protection system of national fitness data privacy should be based on the construction of the dual protection rule system of"law+technology",the structure of the synergistic model of multiple subjects,the improvement of the subject's obligation to fulfill the mechanism,the optimization of the principle of informed consent of data privacy,and the improvement of the platform's internal protection system of data privacy,so as to construct a five-pronged approach.In order to build a new advantage of data privacy protection for national fit-ness,we should start from five aspects.
