涉外法治建设基本原则探析

作为国内法治与国际法治的连接纽带,涉外法治建设面临诸多风险和挑战.为确保涉外法治建设有章可循,需要坚持宪法至上、国家利益本位、风险防控和急用先行等基本原则.坚持宪法至上原则,应当理清宪法蕴含的涉外法治原则,关注涉外立法和缔约程序的合宪性.坚持国家利益本位原则,应当澄清国家利益本位的内涵,明确国家利益的法律界定标准,并加强海外利益的法律保护.坚持风险防控原则,应当注重国际条约、对外交往和国内治理等领域的风险防控机制.坚持急用先行原则,应当弥补涉外法律不足,完善涉外法律体系.
Abstract
As a link between domestic and international rule of law,the de-velopment of the foreign-related rule of law faces many risks and challenges.To ensure that there are rules and regulations to follow,it is necessary to adhere to the basic principles of the supremacy of the constitution,national interest orienta-tion,risk prevention and control,and the priority of urgent issues.Adhering to the principle of the supremacy of the constitution,we should clarify the princi-ples relating to the foreign-related rule of law contained in the Constitution,pay attention to the Constitutionality of foreign-related legislations and treaty-conclud-ing procedures.Adhering to the principle of national interest orientation should clarify the meaning of national interest orientation,ascertain the legal standards of national interests,and strengthen the legal protection of overseas interests.Adher-ing to the principle of risk prevention and control,attention should be paid to risk prevention and control mechanisms in areas such as international treaties,for-eign relations,and domestic governance.Adhering to the principle of the priority of urgent issues,we should bridge the gap of foreign-related laws and improve the foreign-related legal system.
