印太经济框架供应链协议——供应链规制的国际经贸协定新范式及其借鉴
The Indo-Pacific Economic Framework Supply Chain Agreement:A New Paradigm for International Economic Agreements on Supply Chain Regulation and Its Implications

摘要
《印太经济框架供应链协议》是首部以"供应链韧性"为名的国际经贸协定.其谈判模式具有创新性和灵活性,谈判因而得以快速完成.该协议以促进供应链国际合作为核心,通过具有软约束力的实体性义务提升缔约方合作意愿,设立供应链理事会、供应链危机应对网络和劳工权利咨询委员会为合作提供常态化的机制支持.该协议的独特性使其成为供应链规制的国际经贸协定新范式.该协议的"软义务、硬机制"设计契合"一带一路"实践的软法治理理念,符合高质量共建"一带一路"国际合作机制的现实需要.我国可以借鉴《印太经济框架供应链协议》,对该协议内容作适当增减,以形成供应链规制之国际规则和话语体系的中国立场.
Abstract
The Indo-Pacific Economic Framework Supply Chain Agreement rep-resents the first international economic agreement named for"supply chain resil-ience".Its innovative and flexible negotiating model allowed for rapid completion.Central to the agreement is the promotion of international cooperation in supply chains,enhancing the willingness of parties to cooperate through soft law obliga-tions.It establishes the Supply Chain Council,the Supply Chain Crisis Response Network,and the Labor Rights Advisory Board to provide regular mechanism sup-port for cooperation.The uniqueness of this agreement marks a new paradigm in in-ternational economic agreements concerning supply chain regulation.Its design of"soft obligations,hard mechanisms"aligns with the soft law governance philosophy seen in the"Belt and Road"Initiative,meeting the practical needs of high-quality international cooperation mechanisms for the"Belt and Road"Initiative.China could draw on the Indo-Pacific Economic Framework Supply Chain Agreement,ad-justing its content as necessary,to shape an international rule and discourse system for supply chain regulation from the Chinese perspective.
