德国中小学法治教育的价值嬗变、时代特征与改革动向

德国法治教育历史悠久且体系完善,对于国家法治社会的建设与发展影响深远,自第二次世界大战后其价值内涵也发生了新的转变,由"为了民主和法律"的目的型逐渐转向"通过民主和法律"的过程型,积极培养能够"合法、有序、理性参与政治的现代公民".德国将培养具有综合法治行动能力的"社会人"作为课程目标;课程内容覆盖公法、私法和社会法三大领域;通过积极营造真实的法律场景,提升学生法治意识与能力;基于多元主体协同机制,实现课程资源的实时更新.随着信息技术的迅猛发展,德国中小学法治教育呈现了一系列新的变化,彰显出跨文化、数字信息化、教研体系多元化等新的改革动向.
Law-related Education in German Primary and Secondary Schools:Value Evolution,Contemporary Features and Reform Trends
German law-related education has a long history and complete system,which has a profound influence on the development of the country's legal society.With the progress and development of the society,its value orientation has changed from"democracy-and-law-as-end"to"democracy-and-law-as-means",aiming at cultivating"modern citizens who can participate in politics legally,orderly and rationally".The rule of law education in primary and secondary schools takes"social person"with comprehensive rule of law action ability as the curriculum goal.The curriculum content comprehensively covers three major fields:basic law,private law and public law.Various methods are adopted to improve students'understanding of laws and the ability to act to law.However,with time goes by,the law education curriculum in German primary and secondary schools is facing new problems due to cross-cultural context,educational digitization,and pluralistic cooperative teaching and research,which threshold a new trend of development.
