Right Boundary of Patent Infringement Warning Letter
At present,the system of patent protection in China's laws has been continuously improved,and a warning letter of patent infringement has been established.After the rights and interests of the patentee are infringed,the infringer can be stopped by a warning letter of patent infringement.However,due to the imperfect provisions of the law on the warning letter of patent infringement,new problems may arise in the process of issuing the warning letter of patent infringement,and the patentee,as the victim of infringement,becomes a new infringer.This paper analyzes the problems existing in the application of the warning letter of patent infringement,and puts forward corresponding improvement measures to solve these problems,so as to clarify the right boundary of the warning letter of patent infringement,reasonably regulate the publishing behavior of the warning letter of patent infringement,and give full play to the protection of the legitimate rights and interests of the parties.
