摘要
《公共文化服务保障法》是我国文化领域的基础性法律,在《文化产业促进法》等其他文化基础法尚未出台、文化法律体系尚不成熟的当下,《公共文化服务保障法》应当切实担负起支撑文化法律体系建设,承托文化法学理论研究,促进文化强国建设的使命.在理论层面,《公共文化服务保障法》担负着诠释文化法之基本属性,厘清文化法学之建构逻辑的任务.廓清《公共文化服务保障法》蕴含的缘起于行政法底色的文化基础法属性,以及承托的有限政府有为市场有力社会建设、公民基本文化权利保障、文化治理新秩序营造等理论逻辑,是加强新时代文化法学理论研究的内在需求.在现实层面,因应我国公共文化现代化,乃至中国式现代化的基本要求,推进《公共文化服务保障法》深入实施及发展完善,从而推动公共文化管理现代化、促进人民精神生活共同富裕、扩大公共文化双重参与是《公共文化服务保障法》落实时代使命,从文本走向实践的必由之路.
Abstract
The Public Cultural Service Guarantee Law is a fundamental law in the field of public culture in China.In the current situation where other cultural basic laws such as the Cultural Industry Promotion Law have not yet been introduced and the cultural legal system is not yet mature,the Public Cultural Service Guarantee Law should effectively shoulder the mission of supporting the construction of the cultural legal system,supporting the theoretical research of cultural law,and promoting the construction of a powerful cultural country.At the theoretical level,the Public Cultural Service Guarantee Law bears the task of interpreting the basic attributes of cultural law and clarifying the construction logic of cultural law.Clarifying the cultural foundation legal attributes derived from the background of administrative law contained in the Public Cultural Service Guarantee Law,as well as the theoretical logic of the limited government's powerful social construction for the market,the protection of citizens'basic cultural rights,and the creation of a new order for cultural governance,is an inherent need to strengthen the theoretical research of cultural law in the new era.At the practical level,in response to the basic requirements of China's public cultural modernization and even Chinese path to modernization,to promote the in-depth implementation,development and improvement of the Public Cultural Service Guarantee Law,so as to promote the modernization of public cultural management,promote the Common prosperity of people's spiritual life,and expand the dual participation of public culture is the only way for the Public Cultural Service Guarantee Law to implement the mission of the times and move from text to practice.
