NFT图书是区块链与出版业媒介融合产生的新型图书类型.NFT图书铸造流程大体为"选择铸造对象—创建账户—上链—设置智能合约".该流程下铸造行为与出版行为的竞合引发了法律规则上的迷思:已铸造的NFT图书是否应该被视为出版物?销售NFT图书的行为应该适用发行权用尽制度还是信息网络传播权?出版社铸造NFT图书后又该如何进行交存?为了促进NFT与出版、图书行业的融合,宜对铸造流程的各个环节进行规则澄清:应从铸造主体角度出发判断NFT图书的法律性质,而非以是否"上链"作为认定电子出版物的标准;在销售环节以智能合约技术约定的条件为主要参考因素,判断信息网络传播权以及"发行权用尽"是否存在适用场景突破;在交存环节上,应充分利用区块链技术为交存制度的实施机制、补偿机制,实现文化资源的高效保存利用.
Abstract
NFT books are a new type of book created by the convergence of the blockchain and the publishing medium,and the NFT book minting process consists of"select the minting object-create an account-upload to the chain-set up a smart contract".The competing acts of casting and publishing under this process have raised myths about the legal rules:should a cast NFT book be considered a publication?Should the sale of NFT books be subject to the exhaustion of distribution rights regime or the right of information network distribution?How should publishers deposit NFT books after they have been minted?In order to promote the integration of NFT with the publishing and book industries,it is advisable to clarify the rules for each aspect of the casting process:firstly,the legal nature of NFT books should be judged from the perspective of the casting subject,and whether or not they are"on the chain"should not be used as a criterion for determining electronic publications;in the sales process,the conditions agreed in the smart contract technology should be the main reference in the sales process,the main reference factor is the conditions agreed in the smart contract technology to determine whether there is a breakthrough in the application of the right of information network dissemination and the"exhaustion of distribution rights";in the deposit process,blockchain technology should be fully utilized as the implementation mechanism and compensation mechanism of the deposit system to realize the efficient preservation and utilization of cultural resources.
