The Crisis of the WTO Dispute Settlement and Possible Solutions—A Historical Assessment

As the US continues to block the appointment of new Appellate Body members,the dispute settlement system of the WTO is in great danger and members have limited time to work out solutions before its paralysis.History of the GATT/WTO dispute settlement revealed that politi-cal interference has been a longstanding threat to the independence and impartiality of the adjudi-cate body as well as a handy weapon for certain members to increase leverage in negotiations.It is expected that the US will continue this opportunist blockage with no concrete requirements in order to undermine the gains of the Uruguay Round and reduce the current DSS(dispute settle-ment system)to GATT-style power bargains.To prevent the destructive deadlock of the whole sys-tem,it is necessary for members to enforce interim plans to revitalize the DSS and advance WTO reform using a multilateral approach so that the WTO can rebalance its functions as a negotiation forum and a quasi-judicial organ while also maintaining the accountability provided by its rules-based DSS.
