近代中国军事权的宪法规制

摘要
近代中国军事权的规制是伴随着宪政文明的西学东渐而被逐步纳入宪法文本中来,并在一定程度上付诸实施的。从＂文本＂与＂现实＂两种视角对近代中国军事权的宪法规制进行反思,通过对清末直至南京国民政府时期宪法文本中军事权规制的模式选择以及近代中国＂武人乱政＂背景下军事权实践运作的考察,探寻军事权的宪法规制在文本与实践上相互背离的真正原因,并为考察我国军事权的宪法规制提供思考方向。
Abstract
The constitutional regulation of military power in modern China was brought into the constitution text with the entry of the constitutional civilization progressively of western learning into Modern China,and into practice to some extent.From the perspective of the text and the reality,this paper introspects the constitutional regulation of military power,studies the mode of the constitution text regulating the military power in late Qing dynasty and the Nanjing National Government period,investigates the operational practice of the military power in context of ＂Taketo political chaos＂ in that period of China.The research tries to explore the true reason of the deviation between the text and the practice of the constitutional regulation of military power in that period,and offer some food for thought about the constitutional regulation of the military power.
