摘要
突发事件应急管理主要包括紧急规制的创制、司法的限制、行政权的扩张三方面内容.突发事件应急管理中行政应急权的使用可划分为权力的确定、启动、实施、中止几个阶段.影响行政应急权使用效果的因素是多方面的,宏观层面的应急管理体系决定着行政应急权应然层面的基本内容与使用过程,承担权力使用的主体与运行机制决定着权力使用的方式与效率,在法治文化综合下则是应急权使用的实际效果.有针对性地进一步全面深化改革、优化应急管理体系与重视法治文化的培养,既可以从制度、组织等多个层面保证应急权的及时、准确、顺畅行使,也是实现应急管理现代化的必要支撑.
Abstract
Emergency management mainly includes the creation of emergency regulations,judicial restrictions and the expansion of administrative power.The use of administrative emergency power in emergency management can be divided into several stages:the determination,initiation,implementation and suspension of power.Factors affect-ing the effects of administrative emergency right of use is various,the emergency management system on the level of macro determines the level of administrative emergency right ought to be the basic content and the use process,take the main body of power use and operation mechanism determines the way and the efficiency of power use,is under the rule of law culture comprehensive emergency right to use the actual effect.To further deepen the reform comprehensively,optimize the emergency management system and attach importance to the cultivation of legal culture,is not only to ensure the timely,accurate and smooth exercise of emergency right from the system,organiza-tion and other levels,it is also the demand support for realizing the modernization of emergency management.
