Research on the Conflict of Public Security Organizations'Application of Administrative Coercive Measures——From Public Health Emergencies Perspective
When handling administrative cases in public health emergencies,public security organs will encounter conflicts between administrative coercive measures and between administrative coercive measures and administrative detention enforcement.Bases on the a normative and empirical analysis of the applicable conflicts between health administrative compulsory measures and public security administrative compulsory measures and administrative detention enforcement measures,this paper draws the conclusion that compulsory health administrative measures have priority application in public health emergencies.It also proposes improving and optimizing the integration mechanism and the legal provisions according the different causes of application conflicts in order to effectively resolve application conflicts,promote public security organs to improve case handling procedures in law enforce-ment,respond to public health emergencies in a legal manner,improve public security organizations'governance systems,and enhance public security organizations'governance capabilities.
