Predicament and Future Trend of the Artificial Intelligence in Judicial Adjudication
Algorithm judgment is a concrete manifestation of the artificial intelligence in judicial adjudication,promoting the development of judicial intelligence in China.Combined with judicial practice,it is found that techni-cal problems such as algorithmic dark box and natural language processing are not the biggest problems in the cur-rent judicial application,but the conflict between data computation justice and judges'argumentation and reason-ing,the ambiguous scope of application of algorithmic adjudication,and the lack of subsequent relief and account-ability mechanisms.In order to better promote the development of artificial intelligence in judicial adjudication,it is necessary to analyze the case types of staged sentencing and final sentencing of algorithmic adjudication in terms of macro-positioning,micro-deconstruction and mechanism building,and fill in the gaps in relief and accountability mechanisms through legislation in order to realize smart and fair justice.
