Improving Police Cooperation Path to Combat Cross-border Telecommunication and Network Fraud—From the Perspective of China-ASEAN Countries Cooperation Mechanism
In the context of cracking down on telecommunication and network fraud in China,telecommunication and network fraud groups have moved to ASEAN countries in order to evade the crackdown of China's police by tak-ing advantages of conflicts over criminal jurisdiction between countries.With the legal support of international trea-ties,bilateral treaties,multilateral treaties and domestic laws,China and ASEAN countries have jointly established police cooperation such as intelligence and information sharing,stationing police liaison officers,joint investigations and joint operations,making useful explorations for the two sides to further jointly crack down on such cross-border fraud.However,some problems occurs in the process of cooperation,such as the scattered law enforcement coopera-tion documents,unstable cooperation mechanism,inefficient cooperation due to the absence of a coordinating institution,inefficient use of intelligence in traditional information exchange methods,unsatisfactory cooperation results due to uneven capacity of law enforcement.In view of this,it is necessary to institutionalize police coopera-tion mechanisms by respecting the sovereignty of all countries,conducting effective consultations,and jointly formulating comprehensive legal documents,improve the efficiency of cooperation by establishing an authoritative coordination institution to coordinate the opinions of all parties,bridge the information gap between cooperative enti-ties by building an intelligence information sharing database,improve law enforcement capabilities in all aspects by upgrading technical equipment and carrying out police training,thereby effectively improving the quality and effectiveness of China-ASEAN countries police cooperation in combating cross-border telecommunication and network fraud.
