摘要
审讯作为一项延续至今的传统侦查手段,是现代侦查能力建设的重要内容,是侦查智慧的集中体现.但经验式审讯技术严重羁绊当前侦讯能力建设,要从改变指控型审讯范式、重塑证据应用理论、重建对成功审讯的理解三方面入手,重塑侦查审讯理念.并在此基础上,研究探索涵盖前期准备、引导开放供述、封闭问题预排解释、示证攻坚、策略化收尾等阶段的结构化审讯技术之实务应用.
Abstract
Interrogation,as an enduring tradition of investigative method,is an important part of modern investiga-tion capacity building and the concentrated embodiment of investigation wisdom.However,experiential interroga-tion techniques severely constrain current interrogation capability building.In order to achieve the reconstruction of interrogation concepts,we should change the accusatory model of interrogation,reconstruct the theory of evidence application,and rebuild the understanding of successful interrogation.On such basis,this paper explores the practi-cal applications of structured interrogation techniques,including early-stage preparation,eliciting confession through open-ended questions,excluding explanation through close-ended questions,presentation of evidence,and strategic closure.
