当前区块链技术的应用已延伸到社会生活多个领域,展现出广泛应用前景.但区块链技术在给人们社会生活带来便利的同时,一些犯罪分子利用区块链实施洗钱、集资、传销和诈骗等违法犯罪行为,侵犯公众合法权益,严重危害社会安全.为有效打击区块链犯罪,介绍区块链的特点及应用领域,分析区块链犯罪的分类和特征,剖析其犯罪案件侦办难点,从完善法律法规、加强行业监管、强化风险防范、推动各方协作、提高侦办水平、加强引导宣传等方面提出应对区块链犯罪的对策.
Abstract
The application of blockchain technology has been extended to many fields of social life,showing a wide range of application prospects.While the blockchain technology brings various conveniences to social life,some criminals use it to commit illegal and criminal acts such as money laundering,fund-raising,pyramid schemes and fraud,infringing the legitimate rights and interests of the public and seriously endangering social security.In order to effectively combat blockchain-derived crimes,this article introduces the characteristics and application of blockchain,analyzes the classification and characteristics of blockchain-derived crimes,summarizes the difficulties in the detection of such cases.Countermeasures including improving laws and regulations,strengthening industry supervision,enhancing risk prevention,promoting interagency cooperation,building investigation capability,and strengthening guidance and publicity are proposes.
