摘要
ChatGPT技术嵌入法律职业领域可带来诸多便捷,但更应关注其风险问题.ChatGPT技术嵌入法律职业领域存在技术风险、伦理风险和法律风险.面向法律职业技术化存在的风险问题,理念上要牢固树立"以人为中心"法治伦理理念:构建"以人为中心"法治伦理原则,明确智能科技产品在法律职业领域客体定位;思路上要规范生成式人工智能类法律规范同人类社会伦理道德相贯通:细化算法伦理制度,明确主体责任伦理法治化;手段上智能科技企业技术部门要注重自我规制同外部监督相结合、刚性规定与柔性条款相结合等,实现ChatGPT嵌入法律职业契合向善发展.
Abstract
The integration of generative artificial intelligence like ChatGPT into the legal profession can bring a lot of convenience,but more attention should be paid to its risks,such as technical risks,ethical risks and legal risks.Facing such risks,efforts should be made to firmly establish the"human-centered"rule of law ethics in terms of concept with"human-centered",and intelligent technology products as tools in the field of legal profession.In terms of realization path,the normative generative artificial intelligence laws should be in line with human social eth-ics and morals with the algorithm ethics system refined and the legalization of subject responsibility ethics clarified.In terms of means,the technical departments of intelligent technology enterprises should combine self-regulation with external supervision,establish a rigid provisions with flexible clauses to produce generative artificial intel-ligence technologies with fast and agile response in the field of legal profession,so as to realize the development of generative artificial intelligence technologies for good in human legal profession.
