我国食品领域职业投诉举报的现状与对策

随着我国食品安全有奖举报制度和惩罚性赔偿制度的建立,食品领域的投诉举报朝着职业化方向发展,其行为越来越脱离法治的轨道,集中表现为"恶意投诉举报".研究发现,目前对"恶意投诉举报"的认定存在混淆"投诉"和"举报",把"知假买假"等同于"恶意投诉举报",把获取"投诉举报奖励"等同于"非法牟利"等问题,应该坚持主客观相统一的原则进行综合认定.在确定"恶意投诉举报"判断标准的基础上,需要进一步对"恶意投诉举报"进行规制,规制路径需以权利义务为抓手,坚持系统的理念和方法,构建事前、事中、事后全过程的治理体系.
Study on the Present Situation and Countermeasures of Professional Complaints and Reports on Food Field in China
With the establishment of China's food safety reward reporting system and punitive compensation system,complaints and reports in the field of food are developing towards professionalization.Meanwhile,their behaviors are increasingly divorced from the track of the rule of law,focusing on"malicious complaints and reports".Research has shown that,there is a confusion between"complaints"and"reports"in the identification of"malicious complaints and reports",equating"knowing fake and buying fake"with"malicious complaints and reports",and equating obtaining"complaints and reports rewards"with"illegal profits",so it is necessary to adhere to the principle of integrating subjectivity and objectivity for comprehensive identification.On the basis of determining the judgment criteria for"malicious complaint reporting",it is needed to further regulate the"malicious complaint reporting",and the regulatory path needs to focus on rights and obligations,adhering to systematic concepts and methods,and establishing a governance system for the entire process,including before,during,and after events.
