优化营商环境视角下"首违不罚"制度的检视与完善

摘要
市场监管领域"首违不罚"制度的广泛应用为推动建设市场化、法治化、国际化营商环境发挥了重要作用,充分彰显了《行政处罚法》处罚与教育相结合、过罚相当的基本原则.当前各地对"首违不罚"的构成要件认定没有形成统一标准,并存在着适用具体标准不一致、限缩行政机关裁量权等问题.为了更好发挥"首违不罚"制度在优化营商环境中的正向价值,须通过明确构成要件、颁布全国层面的"首违不罚"清单、完善配套措施等方面提升制度实施成效.
Abstract
The wide application of the"no punishment for the first violation"system in the field of mar-ket supervision has played an important role in promoting the construction of market-oriented and law-based international business environment,fully demonstrating the basic principle of combining punishment with edu-cation and equal punishment in the Administrative Punishment Law.At present,there is no unified standard in the identification of the constitutive elements of"impunity for the first violation",and there are some problems such as inconsistent application of specific standards and limitation of the discretion of administrative organs.In order to better play the positive value of the"no punishment for the first violation"system in optimizing the business environment,it is necessary to improve the implementation effect of the system by clarifying the con-stituent elements,issuing a list of"no punishment for the first violation"at the national level,and improving supporting measures.
