网络水军诽谤行为刑法规制问题研究

摘要
近年来,网络推手逐渐发展成网络水军,而刑法上的一些传统罪名在针对网络水军诽谤的适用上治标不治本,且犯罪主体难以确定,单位犯罪的缺失,给游走在灰色地带的网络水军以可乘之机.在言论自由与秩序的碰撞下,刑法当严格遵守其谦抑性原则,以保障人权和优化司法资源配置.此外,还需更加明确界定入罪条件,使司法实践的认定标准更具操作性,从而实现司法的公平正义.
Abstract
In recent years,Internet promoters have gradually developed into online spammer,but some traditional charges in the criminal law treat the symptoms rather than the root cause in the application of online spammer defamation,and the subject of crime is difficult to determine,and the lack of unit crime gives the net-work water army in the gray zone an opportunity.At the same time,under the collision between freedom of speech and order,criminal law should strictly abide by its principle of modesty,so as to protect human rights and optimize the allocation of judicial resources.In addition,it is necessary to define the conditions of crime more clearly,so as to make the recognition standard of judicial practice more operational and realize judicial fairness and justice.
