The Realization Path and Justification of Digital Human Rights
This paper discusses the legitimacy and reasonability of digital human rights as the independent fourth-generation human rights in terms of the digital attributes,right forms,obligation systems and power structures of people in the digital era.Digital human rights advocate the core concepts of cooperation,sharing and co-governance,emphasize the connotations of rights such as survival,development,equality and dignity,and safeguard the basic rights and value of individuals in the digital society.Digital human rights can construct its autonomous right system from the perspective of legal norms,update and improve the basic rights of traditional human rights,and develop the rights to Internet access,being offline,being forgotten,and the digital environment,so as to ensure the integrity of denotations of human rights in the digital era.The realization of digital human rights should focus on shaping the digital order through the interaction and integration of digital technology and legal governance,bridging the gap between the rich and the poor in the digital society through digital inclusion,ensuring basic digital civil rights by protecting vulnerable groups,and promoting the mutual benefits of digital human rights and digital sovereignty in the context of digital equality.
