通过分析"美式"双边投资条约、欧盟投资法院体系及联合国国际贸易法委员会第三工作组对上诉机制改革草案中的上诉审查范围,提出现有上诉审查范围存在上诉审查范围的宽泛、标准模糊、上诉程序与撤销程序的关系不明的问题,并通过明确上诉机制的权能加以解决.最后,立足于我国国情,提出我国在ISDS上诉机制改革中的态度,以及在签订双边投资协定中,纳入上诉机制条款,为后续投资者-国家间的投资争端改革奠定基础.
Abstract
By analyzing the scope of appellate review in the draft reform of the appellate mechanism in bilater-al treaties,the EU investment court system and the third Working Group of the United Nations Commission on In-ternational Trade Law,this paper points out that the existing scope of appellate review has broad scope of appellate review,vague standards and unclear relationship between the appellate procedure and the revocation procedure,and it can be resolved by clarifying the power of the appellate mechanism.Finally,based on China's national condi-tions,this paper proposes the attitude in the reform of the ISDS appeal mechanism and includes the provisions of the appeal mechanism in the signing of the bilateral investment treaty,which may lay the foundation for the subse-quent reform.
