The Regulatory Dilemma and Path Selection of Anti-monopoly Under Algorithmic Collusion
Algorithms have played a positive role in improving resource allocation efficiency,achieving precise push,facilitating search and saving transaction costs,while also bringing about the problem of algorithm abuse,among which algorithmic collusion is a prominent issue.Due to the characteristics of various forms,stable structure,covert behavior and intelligent operation,algorithmic collusion makes it difficult to break the market monopoly structure once it is formed.Regarding algorithmic collusion,there is currently a lack of clear subjective awareness among the conspirators at the technical level,making it difficult for regulatory agencies to identify collusive behavior based on existing technology.At the system level,the mechanism for assuming the responsibility of the conspiring parties is vague,and the leniency system is not perfect.There is insufficient coordination at the governance level and a lack of multi-party participation in regulation.Based on the actual situation in China,the government needs to clarify the boundaries of regulation,relax recognition standards,and improve regulatory techniques.Clarify the types of collusion and confirm the responsible parties.Improve the leniency system and establish extra leniency system.Standardize algorithm disclosure and promote multi-party participation.Based on competition policy,regulate the behavior of market entities and promote the healthy and orderly development of China's digital economy.
