外来入侵物种罪"情节严重"标准的司法适用研究

摘要
外来入侵物种已经成为我国生态环境保护和经济增长的严重阻碍.针对外来物种入侵愈演愈烈的严峻形势,《中华人民共和国刑法修正案(十一)》增设非法引进、释放或者丢弃外来入侵物种罪.分析条文语法结构,该罪属于抽象危险犯,只要行为人未经允许实施引进、释放或者丢弃的行为,公安司法机关就可对其追究刑事责任.追究本罪的难点在于"情节严重"要件,应从本罪抽象危险犯、行政犯的性质出发解读"情节严重"内涵,刑法设定本罪保护的法益视阀探讨"情节严重"标准的制定,综合考虑涉及法益、本罪性质等各种因素设定"情节严重"标准.
Abstract
Invasive alien species have become a serious obstacle to China's ecological environment protection and economic growth.In response to the increasingly severe situation of alien species invasion,"Amendment(XI)to the Criminal Law of the People's Republic of China"adds a new legal provision to respond to the situation of invasive alien species.Analyzing the grammar structure of the article,the crime belongs to the abstract dangerous crime,as long as the perpetrator carries out the act of introducing,releasing or discarding without permission,the public security judicial organ can investigate the criminal responsibility.The difficulty of investigating this crime lies in the requirement of"serious circumstances".The connotation of"serious circumstances"should be interpreted from the nature of abstract dangerous crime and administrative crime,and the formulation of the standard of"serious circumstances"should be discussed under the legal interest valve of criminal law to set the protection of this crime,and the standard of"serious circumstances"should be set comprehensively considering various factors involving legal interests and the nature of this crime.
