In advanced autonomous vehicle mode,the duty of care of the operator in the vehicle is still controversial,and is often confused with the duty of care of the operator in the conditional assisted driving vehicle.The duty of care of the operator inside the vehicle can be divided into state maintenance duty,vigilance duty and takeover duty from the time sequence and scene division of the duty of care.To optimize the duty of care of the operator,it is necessary to amend the Road Traffic Law and other relevant laws and regulations to increase the provisions on the rights and obligations of the advanced autonomous vehicle operator,clarify the status maintenance obligations of the operator,and clarify the vigilance and takeover obligations of the operator inside the L3 and L4 autonomous vehicle.The operator's duty of vigilance is limited to ensuring that the car is in the designed operating range,and the operator's duty of taking over is strictly limited.
