新时代我国生态文明建设法治化的困境与出路

摘要
生态与法治的深度融合成为新时代我国生态文明建设最显著的特征,但受工业文明时期经济理性思维的影响,当前生态文明建设与法治化的要求尚存差距,立法体系性和协调性相对阙如、执法制度体系和资源配置杂乱、司法专业水平和保护力度不够、守法社会援助和激励机制欠缺,严重影响了生态文明法治化建设的进程.立足于国情现实,应继续坚持建设中国特色社会主义的生态文明法治化道路,始终坚持生态文明立法先行,以良法为目标构建生态文明法治体系,同时在法治政府架构下严格生态文明执法,在司法体制改革中创新生态文明司法,并以正向激励为中心推动生态文明守法,让法治为生态文明建设保驾护航.
Abstract
The deep integration of ecology and the rule of law has become the most prominent feature of China's ecological civili-zation construction in the new era.However,due to the influence of economic rational thinking in the industrial civilization era,there is still a gap between the current requirements of ecological civilization construction and the rule of law.The legislative sys-tem and coordination are relatively lacking,the legal system and resource allocation are chaotic,the level of judicial expertise and protection is insufficient.The lack of legal social assistance and incentive mechanisms seriously affects the process of ecolog-ical civilization and rule of law construction.Based on the reality of China's national conditions,we should continue to adhere to the path of ecological civilization legalization in building socialism with Chinese characteristics,always prioritize ecological civili-zation legislation,and build an ecological civilization legal system with good laws as the goal.At the same time,we should strict-ly enforce ecological civilization law under the framework of a rule of law government,innovate ecological civilization justice in the reform of the judicial system,and promote ecological civilization law-abiding with positive incentives as the center,so that the rule of law can safeguard the construction of ecological civilization.
