Judicial Guarantees for Forging a Strong Sense of Community for the Chinese Nation:Jurisprudential Connotations and Mechanism Paths
The rule of law is a vital guarantee for modernizing the governance system and enhancing governance capabilities in ethnic affairs.Developing a robust community consciousness for the Chinese nation,rooted in the rule of law,necessitates a re-sponse from fundamental legal theories.In the context of Chinese jurisprudence,the legal essence of the"Chinese National Com-munity"encompasses:a community perception of judicial fairness,a cultural community within Chinese judicial culture,a shared destiny in frontier judiciary,and a participative community in judicial governance.The cohesive understanding of public authority,the central role of judicial power,the intersubjective dynamics in judicial fields,the harmonious direction of Chinese judicial culture,and the constitutional norms uniting nation and ethnicity,together form the structural,cognitive,relational,contextual,and normative foundations for the judiciary's role in cultivating a strong sense of community for the Chinese nation.Based on the legal essence of the Chinese national community and the judiciary's internal mechanisms for safeguarding this con-sciousness,this paper proposes a practical approach for grassroots judicial systems to reinforce this community sense.
