Systematic Establishment of the Basic Provisions of the Sub-parts of the Ecological and Environmental Code
Sub-parts are the application of the general part,subject to the review by the general part and feedback on the de-velopment of the general rule.Due to the differences in the regulatory objectives,targets and means between the various sub-parts,the basic provisions are necessary to ensure the logical consistency,comprehensiveness,value consistency and policy co-ordination of the Code.To this end,the basic provisions of the sub-parts shall play the dual roles of the specific and special norms of the general part,as well as the basic and comprehensive norms in the sub-rule.The basic provisions of the sub-parts shall be established according to the dual roles:firstly,we can get the candidate norms including the legal principles and basic regulatory instruments in a top-down way from the Environmental Protection Law;secondly,review the basicity and comprehen-siveness of the candidate norms in a bottom-up way according to other special environmental laws.
