Legal Mechanisms and Elementary Path for Optimizing Leading Cadres'Fault-Tolerance and Error-Correction Mechanisms
The fault-tolerance and error-correction mechanism for leading cadres is a systemic achievement won by following the guid-ance of the theory of socialist rule of law with Chinese characteristics,integrating the principles of governing the country according to law and governing the Party in accordance with regulations,and upholding the unity and coordination of reform and the rule of law.However,the three practical dilemmas,namely,"emphasizing accountability over fault tolerance","prioritizing fault tolerance over error correction",and"valuing order over efficiency",indicate that the current fault-tolerance and error-correction mechanisms for leading cadres are afflicted with such problems as operational deficiencies on a normative level,difficulties in striking a balance on a value level,inadequacies in clarity regarding constituent elements,and ambiguous definitions concerning the scope and boundaries of these mechanisms.Therefore,it is imperative to straighten out the legal logic of optimizing the fault-tolerance and error-correction mechanism for leading cadres,and establish a harmonious symbiotic relationship between the three aspects,with which fault tolerance and accountability are unified,fault tolerance and error correction are balanced,and error correction and accountability are integrated.
