"Dual-Goal"Sovereignty Theory Innovation and Cross-Border Data Flow Ginzo
The cross-border data flow governance policies of various countries are undergoing new changes as the global digital transformation deepens,which could not be fully responded by extant theories.This paper argues that the conventional understanding of the policy trade-off between risk control and development promotion is superficial which ignores the possible theoretical innovation on data sovereignty.Different from the traditional sovereignty theory that emphasizes the power based on a specific geographical boundary,the paper proposes that data sovereignty should be committed to achieving the"dual-goal"of national interests and the interests of others because of the mobility and externalities of trans-border data flow.The key to realize"dual-goal"data sovereignty is to explore international cooperation mechanisms,including regulatory cooperation,institutional consistency,and soft law governance.Based on the theoretical innovation,this paper further proposes three suggestions for the reform of China's cross-border data flow governance system,focusing on data classification,technology governance,and digital product or service governance.
