量子计算背景下网络空间安全法律责任的认定与承担

近年来量子计算作为一种新型计算方式在全球范围内取得了显著的进展.量子计算技术的兴起将改变网络安全的防御规则,量子机密和量子通讯技术是量子计算领域中两个相互关联且至关重要的分支技术.它们利用量子力学的独特性质,为信息安全传输提供了全新的解决方案.由于量子计算技术能够轻松搞定传统公钥加密算法,加大了数据存储与传输的安全隐患,量子攻击手段多样化,综合破坏力强大,倒逼各国重构网络安全防御体系.未来网络安全保护将呈现出升级网络安全保护技术、重置交叉学科格局、零信任安全理念的兴起、攻击与防御技术交替迭代升级、国家安全战略的不断调整等发展趋势.网络空间安全法律体系是维护国家网络空间安全的重要保障.目前,现行网络空间安全的法律保障能力显得力不从心,需要重构网络空间安全法律责任认定原则和标准,提高网络空间安全法律责任承担率.
Quantum computing,as a new type of computation recently,has made significant progress globally.The rise of quantum computing technology is set to change the rules of cybersecurity defense.Quan-tum cryptography and quantum communication technology are two interrelated and crucial branches of quan-tum computing.Leveraging the unique properties of quantum mechanics,they provide a novel solution for se-cure information transmission.As quantum computing technology can easily handle traditional public-key en-cryption algorithms,it increases the security risks of data storage and transmission.Quantum attack methods are diverse and possess powerful comprehensive destructive power,forcing countries to reconstruct their cy-bersecurity defense systems.In the future,cybersecurity protection will show trends such as the upgrading of cybersecurity protection technology,resetting the layout of interdisciplinary fields,the rise of zero-trust se-curity concepts,alternating iterations of attack and defense technologies,and continuous adjustments to na-tional security strategies.The legal system of cyberspace security is a crucial guarantee for maintaining na-tional cyberspace security,.Currently,the legal protection capacity of existing cyberspace security is insuffi-cient,necessitating the reconstruction of principles and standards for identifying legal responsibilities in cy-berspace security and improving the rate of undertaking legal responsibilities in cyberspace security.
