Cross-border data flows are prone to security risks,and in practice,face challenges such as insufficient regulatory efficiency,imperfect regulatory systems,and poor regulatory outcomes.The root cause is that China currently lacks a mature theoretical basis for its regulation.Responsive regulation theory empha-sizes the positive interaction between regulatory agencies and the regulated,calling for the mobilization of va-rious forces to participate in the regulatory process.This theory is quite suitable for China's current needs in the regulation of cross-border data flows and has been fully applied in the data regulation fields of Europe and the United States,providing experience for China's cross-border data flow regulation model.Both prac-tical and theoretical analyses lead to the conclusion that this theory is applicable to China's current cross-border data flow regulation field.Based on this,the article proposes,in conjunction with responsive regula-tion theory,to adhere to a scientific regulatory concept and promote the development of cross-border data flows,specifically as follows:(1)Based on responsive regulation theory,adhere to the concept of multi-stakeholder participation,promote cross-departmental collaborative regulation,and enhance interaction be-tween government and enterprises.(2)In the practice of cross-border data flow regulation,adopt tiered and categorized regulation to optimize regulatory efficiency.
