摘要

算法的客观理性属于算法的技术特征,指向的是算法计算的客观性.在算法犯罪场景下,算法理性围绕算法法益及其规范保护展开.算法法益的构造以算法安全、算法公正为核心,具有双重法益形态.逻辑上,算法安全法益的理性构造与算法公正法益的逻辑创新,符合算法理性的认识论要求,亦反映了理性算法的价值论评价.基于理性主义立场,通过对财产犯罪典型范式的规范性解释,类型化界定行为论上形式可罚性与结果论上实质可罚性的基本标准,可彰显算法法益理论的可解释性、可实践性以及犯罪论上行为的可责难性,以回应人工智能时代推进刑法现代化的基本要求.

Abstract

Absrtact:The objective rationality of algorithms belongs to the technical characteristics of algorithms,pointing to the objectivity of algorithm calculations.In the context of algorithmic crime,algorithmic rationality revolves around algorithmic legal interests and their normative protection.The construction of algorithmic legal interests is centered around algorithmic security and algorithmic fairness,with a dual form of legal interests.Logically,the rational construction of algorithmic security interests and the logical innovation of algorithmic justice interests conform to the epistemological requirements of algorithmic rationality and also reflect the value evaluation of rational algorithms.Based on the rationalist stance,the normative interpretation of typical para-digms of property crimes is used to define the basic standards of formal and substantive punishment in behavior theory through typology,in order to demonstrate the interpretability and practicality of algorithmic legal inter-est theory and the difficulty of accountability in behavior theory,in response to the basic requirements of ad-vancing the modernization of criminal law in the AI era.
