Functionalism Trend of Legal Interpretation in Environmental Administration:Taking Policy Support as the Core
The problem of interest cognition accompanied by the complexity of environmental interests and the problem of value selection accompanied by the relevance of environmental interests highlight the func-tionalism trend in the legal interpretation of environmental administration.The trend of functionalism does not mean that normalism is ignored,but needs to get rid of unilateral textual thinking or instrumental thinking,and translate the interest orientation and value choice in practical situations through functionalism to form a dif-ferent interpretation scale and transition to the understanding of administrative behavior elements.It can't be limited to the internal discussion of environmental law.On the basis of setting the legal basis for literal interpre-tation and historical interpretation,and providing embedded channels for purpose interpretation and system in-terpretation,relying on the strongly related environmental policy,the process of legal interpretation should be reasonably guided through the path of information supplement and result evaluation.
