空间面向视域下的长江经济带协同立法

长江经济带协同立法打破了单一地方立法的空间范围,旨在实现法治在流域空间的拓展.在推进生态文明法治建设的要求下,长江经济带协同立法应以不突破现有立法体制为前提,以整体利益原则、利益协调原则、因地制宜原则为遵循,推动长江经济带形成协同治理,优化全区域整体利益关系的功能价值.为完善长江经济带协同立法体制机制,应明确地方政府的协同立法主体资格,设立立法协调机构和信息共享机制,健全生态补偿机制,强化公众参与机制,完善备案审查机制,从而提升协同立法的效率与效果.
Collaborative Legislation in the Yangtze River Economic Belt under the Perspective of Spatial Orientation
The coordinated legislation of the Yangtze River Economic Belt breaks the spatial scope of sin-gle local legislation and aims to realize the expansion of the rule of law in the basin space.Under the require-ment of promoting the rule of law of ecological civilization,the collaborative legislation of the Yangtze River Economic Belt should be based on the premise of not breaking through the existing legislative system,and fol-low the principles of overall interests,coordination of interests,and local conditions,so as to realize the func-tional value of forming collaborative governance in various parts of the river basin,and optimize the overall in-terest relations among the whole region.In order to improve the institutional mechanism of collaborative legisla-tion in the Yangtze River Economic Belt,the efficiency and effect of collaborative legislation should be en-hanced by clarifying the qualification of local governments as the main body of collaborative legislation,setting up a legislative coordination organization and an information-sharing mechanism,sounding the mechanism of ecological compensation,strengthening the mechanism of public participation,and perfecting the mechanism of filing and reviewing,among other initiatives.
